Benay L. Josselson is the founder of Josselson Law PLLC, where she works closely with start-ups, small and mid-size businesses and individuals on legal and employee relations matters. Ms. Josselson provides practical, realistic advice during every stage of the employment relationship to clients in a wide array of industries, including financial services, health care and not-for-profits.

Ms. Josselson routinely advises managers, human resources professionals and in-house counsel in matters related to employment policies and practices, hiring and termination decisions, employee disciplinary issues, compensation matters, leaves of absence, restrictive covenants, reductions in force and state and federal WARN compliance, independent contractor issues, and post-employment obligations, among other issues.  She regularly drafts and negotiates employment agreements, separation agreements, confidentiality and non-disclosure agreements, restrictive covenants, and consulting agreements on behalf of businesses and executives. 

Ms. Josselson develops and implements employee handbooks and policies in compliance with federal, state and local employment laws, and consistent with human resources best practices.  She also conducts trainings for businesses on workplace issues such as discrimination, appropriate workplace conduct, interviewing techniques and performance management.  She audits personnel files and FLSA exemptions to ensure businesses’ compliance with federal and state law, and represents executives in connection with transactional matters.  She conducts workplace investigations into internal employee complaints.

Prior to founding Josselson Law PLLC, Benay worked for twelve years as an employment attorney in the Litigation group at Seward & Kissel LLP.  Ms. Josselson represented financial services firms, not-for-profits and shipping companies in employment, contract, partnership, and general commercial disputes in federal and state courts and in arbitration, as well as before administrative agencies, including the Equal Employment Opportunity Commission and the New York State Division of Human Rights.  She also counseled these clients on a wide variety of employment matters and issues relating to compliance with trade sanctions.

 

Ms. Josselson earned her Juris Doctor from Fordham University’s School of Law, where she graduated summa cum laude, and she received a BA in Political Science from George Washington University.

 

Ms. Josselson is admitted to practice in New York and New Jersey.

Reductions-in-Force​.  

As your business evolves, you will routinely re-evaluate how best to organize your personnel to maximize productivity in a cost-effective manner.  We have significant experience strategizing, preparing for and executing restructuring and reductions-in-force.  We will collaborate with you on your business goals and objectives, help you develop selection criteria, analyze the discriminatory impact of different selections, prepare the relevant documentation for implementing the reduction or restructuring, and prepare you for meeting with affected employees.  

Workplace Audits

No one wants to be at the wrong end of a governmental audit.  We will prepare you for your communications and/or visits with the auditor(s), review what records should be provided to the government, and work on any written responses that become necessary.  Most importantly, we will be available to answer your questions in real time, and recommend and help you implement revised employment practices to the extent they are necessary.
